    Thanks Amethyst,
    Yes the defence and set aside application both explicitly mentioned that I’d made payment under duress to the HCEO. I spoke to the court clerk today and they’ve asked me to put in writing the issue that I’m not happy with and apparently the Jusge will look at it.

      If this is allowed to stand then to me it makes a mockery of the Set Aside process. I would guess that someone at the Court has their wires crossed and did not realise what the Application was for.

        Yes it does seem a bit underhanded from my new knowledge of how things are supposed to work. I’ve sent a letter to the Court and will update when I hear back.

          Well it’s been a while but I’m still no further ahead. After sending a concise letter with each issue numbered seperately for clarity, I’ve just been told by a clerk that the case is settled so that’s that. My argument about it not being settled and the apply to set aside only made after payment to the bailiff seems to have gone ignored. So much for fairness in the courts system!
