  • Help please! Ex wife and my inheritance

    I am currently divorced.* My ex-wife has avoided and delayed the financial settlement.* We are now in mediation and one of the questions asked is about my mother's inheritance ?* My late mother's estate was complex and has not been settled after several years.* Is she entitled to any; and if so can this be thwarted or exacerbated ?

    Did you have any settlement agreement before your divorce was finalised?

    Yes she may have a claim over part of your inheritance, and your pension, as well as housing, maintenance etc. What can be negotiated in mediation and what she might be awarded by a court may be very different - your starting point really should be to find out exactly what she is likely to be awarded should it go to court so you have a good idea what to offer at mediation and whether it is going to be better or worse than going through court ( taking into account the costs of doing so of course ). I'd get some formal advice from a family lawyer before responding further to the mediators tbh.
