  • Data Protection Act Consent Form

    I have worked for the last 7 years for a limited company and have been asked yesterday by email to complete a Data Protection Act Consent Form.
    The form is asking for all the usual information name/d.o.b/home address/NI number etc etc.

    The odd questions are with regard to if I am a smoker/disabled/ details with regard to my private vehicle - reg/make/model/type/fuel type/colour/engine size (we don't use our own vehicles for business use)

    The form goes onto to consent to:

    providing info to future purchasers of the company and transferring info about me to a country or territory outside the EEA. European Economic Area

    My question is do I have to complete the form?

    It might be worth posting a copy of the form up for us to see, it sounds like your employer is wanting update their HR records.

          Okay, so this is your company updating their HR records and hedging their bets about Brexit I'd imagine. The consent form reads pretty standard and the bit about other companies is in case someone buys the current company the new one doesn't have to have the cost of getting all employees consent to process the data again. And likewise the EEA, if they choose to relocate the headquarters to France for example after Brexit to remain in an EU country then they can take your data with them.

          A lot of employers ask health questions, so if you're a smoker they might choose to offer to help you quit as a healthy worker is a more productive one. If your disabled they might need to help you and my company asks for vehicle details because then they know that all the cars in the car park are belonging to employees.

          Whether or not you have to complete it I don't know, but it doesn't seem to me that your employer is up to anything sinister and are just ensuring their house is in order.

          They're a bit daft really as they're going to have to do it all again in May anyway I'd imagine when GDPR kicks in, so would have probably been better waiting until then.

              It certainly does sound like it, getting their house in order along with ensuring they have all the correct legal consents in place ready for the sale.
