  • Agency Worker to Employed Staff - Length of Service? and Loyalty Benefits?

    Hi all,

    My employer offers a loyalty bonus of an additional 5 days annual leave each year after 5 years continued service.

    However when I first started, I was employed as an Agency Workers for the first two years (post 2011 Agency Worker Legislation), and so have technically only been a true company employee for 3 years.

    My question is, that with the changes that came in to effect for Agency Workers on Oct 1st 2011 - Should the two years I was employed via an agency count towards my 5 years continued service so that I should now benefit from the additonal 5 days leave?

    No, those two years don't count towards your continuous employment. The agency worker regulations are about entirely didn't circumstances. Sorry but you have another two years to wait.
