  • Disciplinary hearing tomorrow. Should I resign before?

    I have a disciplinary hearing tomorrow for gross misconduct. I'm almost certainly going to be fired. For my own best interests should I resign now before the time of the hearing or do it at the start of the meeting? I've only worked for the company for a year so I have no rights to try and save my job.

    Is there any relation to the disability discrimination you had to deal with at your previous employer ? Or have you done something at this job that would warrant dismissal on gross misconduct grounds ?

      Hi [MENTION=70535]Acjb007[/MENTION]. It would be really useful if you could give an indication of what you have done that may lead the outcome of the disciplinary hearing tomorrow to be dismissal on the ground of misconduct.

      With the limited information I am presuming that you are thinking about resigning as this may look better on any reference. My word of caution is that a new employer may ask whether there was any disciplinary record on your file in which case this issue may still come to light.

        It's not related to my previous thread. In our store when items get reduced that are going out of date we are not allowed to reduce our own items. We all do it, including a couple of the supervisors. However it was my staff number that got checked and they're saying it is gross misconduct due to theft of company goods. The store manager said he'd let me off but as head office have noticed he can't control the outcome. I basically want the best possible outcome. If I quit can I claim jsa? Will my reference say left pending investigation? That would look better than dismissed due to gross misconduct.

          I think the following is correct in regard to JSA.

          If you chose to leave your job you need to show that you had ‘just cause’ for leaving. In any assessment of your entitlement to JSA you ex-employer may be asked to comment on any statement you make. A decision about your eligibility will be based on a number of things, which include whether it was reasonable for you to take the action you did. If it is decided that you left your job without just cause, you may lose your entitlement to JSA for between 1 and 26 weeks.

          In regard to a reference it will depend on what any new employer asks in term of a reference. If you do decide to resign it may be a question to ask your employer in regard to how they will detail your departure from the company to any prospective or new employer.
