  • Confidentiality agreement

    Hi,

I recently signed a confidentiality agreement with my former employer, agreeing not to speak about the settlement they offered me or to say anything disparaging about the business.

I may have told one or two people about the settlement, before I signed the agreement. Is this going to count against me, if they found out about it? I have not said a word since signing the agreement, and I have, in fact, removed a couple of reviews I made about them as a business on glassdoor.com.

I don't expect they will find out in any case, but as it comes with the threat of paying back the settlement, I'd like to know where I stand, just in case.

Does this non disclosure or confidentiality agreement work retroactively, or is it from when I signed the document? I don't intend on ever speaking about them again, as far as I'm concerned I'm through with them, completely.

Once again, any advice is greatly appreciated.

    Re: Confidentiality agreement

Unless the contract was worded to cover anything said retrospectively, then the confidentiality obligations apply from the date of the agreement being signed

Cheers Rob, that's what I'd hoped. I had a vision of them trying to claw back the money they've to pay me, but that puts my mind at ease, somewhat.

It would be difficult in that situation to add it retrospectively because you would have ultimately told someone about it prior to signing, and once someone knows you can't wipe their memory I can't see them being able to enforce it retrospectively, that reason so providing you don't talk to anyone about it moving forward then you should be fine.
