  • Repayment of Training Fees

    First post so go easy....
    To cut a long story short my employer paid out £850 on a nurse training course for me. We signed an agreement to say if I left the business within a certain time £850 was repayable by me to him and he could deduct this from my final wage. Agreement signed.
    Then he had to pay £300 out for exams but we didn't discuss me paying this back or update the contract.
    5 months later I've decided to resign due to many reasons.
    He's now demanding the training fees back plus the exam fees.
    He owes me £527 in wages.
    I am happy for him to take this and pay him the remaining £323 to cover the total of £850 but he is now telling me he wants the exam fees of £300 back as well.
    Legally can he demand this money from me as we never updated the contract and all my contract states is Course training "Contract" states £850 to be reimbursed to employer if termination from either party of employment occurs.

    Any help would be great

        Ok

        Does the agreement that you signed state specifically that the employer can deduct the payment from your wages, or does it just say that it has to be repaid?

          Yes it does say he can deduct from my wage. I'm happy for him to do this and to pay the remaining £323 it's the extra money he's demanding that isn't covered via the contract I'm concerned about....

            ...and as the agreement states a specific amount,that is all that he can demand.
            IMO you should reject his demands for the exam fees.

              I have penned a letter of response as he is demanding £1300 via email. I have informed him that any other correspondence will only be answered via post he has given me 7 days to pay this apparent £1300 and stated my owed wages will be paid on 5th September. Any idea on how I proceed further with this?

                £850 (training fees) plus £300 (exam fees)= £1,150.
                Does he say where the extra £150 fits into his calculations?

                Not much you can do except reiterate that your liability is £850 for training fees as per the agreement.
                Wait and see what his next move is.

                  I'm not sure to be honest! He's not very clever in terms of maths that's for sure! I've just sent a response stating that the contract only asks for £850 and that's all I'll be paying so we will see what he says next!

                    Does the agree you signed include training plus examination fees or training and examnation fees?? Reading your 1st post you state the contract states £850 is due to the employer on termination of contract. IMO that is the level of your liability.

                      I agree with all the others above and it's confirmed in the Employments Rights Act 1996 at s.13(1)(b) ands.15(1)(b) below.
