    For the purposes of calculating the 11th and 15th weeks before the expected week of childbirth you count backward from the Sunday at the start of the week of your due date.
    So, the 11th week would start on the 8th May.

          Hello everyone,

          Sorry for my silence this past day or so whilst everything has been happening and [MENTION=19071]teaboy2[/MENTION], thank you for checking in.

          I sent the director my formal notification of pregnancy and clearly stated dates and shared proof etc. I had no reply but was asked for a meeting at the end of the day yesterday. Meeting went well and he confirmed receipt of my email and also confirmed that I am indeed entitled to everything stated re. SMP which is a huge relief. My notice period still stands at 3 months taking me to the end of April. I will then have two and a bit further months before the baby is due to gain more employment. Luckily in my industry there are lots of freelance options available...just not sure how employable I will be at 7+ months pregnant!

          It's a shame I have no real grounds for the employment tribunal as it's been a very unfair booting out, but must move forwards from this and thing about the more important things in life!

          Thank you to everyone who contributed in this thread, you really helped so much when I was feeling very anxious and upset.

            That's great news, you've got his acceptance of the SMP in writing? Thank you for coming back and letting us know.

            I am sorry about your job, even though you have got the SMP sorted it still leaves you with uncertainty when you really don't need it. What is it you do? ( that might be too nosey - in which case ignore me)

              I still don't think the dismissal is fair to be honest and could well be wrongful dismissal as a result of the employer claiming perfromance issues were the reason for dismissing the OP via way of notice. They would still have to follow a disciplinary process and give the OP opurtunity to improve their work performance in order for it to be fair. Failure of any disciplinary process to be followed is wrongful dismissal as it amounts to a breach of contract. Wrongful dismissal, like automatic unfair dismissal (and likewise discrimination claims) does not require the OP to have had 2 years continous service with the employer in order to bring a claim against them.

              So question is @Penguin123 - Have you anything in writing from the employer confirming what was said about your performance etc?
