    Hi,

    I was given a heads up by a day shift colleague that were working on Boxing Day :mmph: and due to the circumstances around the festive season I, a night shift worker am going to be told to come and work day shift for that day which I want to refuse to as I'm a permanent night shift worker.

    It would be impossible for me to work my scheduled night shift that day due to lack of supervision as i'd be the sole person in a large work place so I'd rather just take that day as a holiday or unpaid leave but with my management team being an unreasonable lot I doubt they would give me it.

    Do i have the right to challenge them about it or do just have to suck it up.

    Here is an extract from my employment contract under Hours:

    Is it specific enough to justify the forced change?

    Hours:


    Your hours of work are 19:00 hours to 07:00 hours following the Pitman shift pattern
    and your will receive 95 minutes of rest breaks each shift.
    Due to the nature of the work carried out by 'Company' it may be necessary for your
    working hours and meal breaks to be varied. The times will be set from time to time
    by 'Company' and notified to you in advance. From time to time, you may also be
    required to work overtime in addition to your basic hours.

      You could try submitting a holiday request for boxing day and crossing your fingers.
      However your employer is entitled to refuse to grant it.

      The quoted contractual clause is definitely wide enough to entitle them to require you to work the day shift on Boxing day.

        Thanks for the reply.

        Do they have put it in writting or does verbally suffice.

        So far they haven't approched me to say I am working dayshift on the said day, I think they just expect me to turn up.

        How much advance notice should they give? They way it is written in the clause is very generic it could mean 1-2 days or 1-2 weeks notice.

          no disrespect but you say you was given a heads up by a day shift colleague that were working on Boxing Day
          and that So far they haven't approched you to say I your working dayshift on the said day
          have you thought this may have have been a wind up
          as it's not official as of yet
          i would not take the word of a day shift colleague just take the day off
          Don't let them grind you down
