Re: have been given 5 days then i have been given 5 days then i have to

hi no i am digusted it even mentions dismissal as he said right at the beginning as long as i made myself available to there resourse team 5 days a week i could carry on for 5 years doing daily shifts no mention of dismissal in the slightest and to send this letter makes me ill and my wife would be inpieces she is almost suicidal already over another problem causing us to move house at the momentyes he did mention redundancy but no figures he seems to be puting his foot in at a bit.

It sounds to me as if he is trying to cover his backside , if he can't find you permanent work he then has the option of dismissal. You have been told you have grounds for appeal?
I would be appealing and asking for a written statement as to why you are being dismissed .

Without knowing exactly what has been said or written it is difficult to form an opinion.

Get your appeal in, get an appointment at CAB and get any paperwork you have together , that would be contract, terms and conditions and any correspondence that has taken place over this situation.

I think we all understand why you are feeling panicky, it is only natural.
If you want to ask him about dismissal , maybe you need to phrase it in a non confrontational way somthing along the lines of

          Dear xxx
I am a little worried after receiving your last letter, In it you mentioned dismissal and this is the first time I have heard this. I thought that you were quite happy to keep me working for you as long as I was willing to be flexible and work where needed. Could you please explain as it is causing me some distress and I need to know if I should be looking for another job.
          Yours xxxx

Lets just wait a bit to see if anyone has a better idea than that.

I was under the impression that your boss (not the guy at the diy place) had been quite helpful and nice so another option might be

          Dear xxxx

I would like to thank you for the support you have given me over the last few weeks, however since receiving your letter of xxxxxx where you mention dismissal I am confused and concerned. I thought that you did not want to dismiss me. Can you please explain so I know if I should be looking for another job

Reading between the lines I think they would like you to leave because then they wouldn't have to pay you, wouldn't have to pay you redundancy so it would save them money.

If you want a more direct and forceful approach I am sure that can be sorted, what I was trying to avoid was conflict if this is all a misunderstanding so if you choose one of the first two letters try to put it in your own words. If you want to be formal and official, that can be arranged.

thanks very much for what you have done i will do something round what you have written but as unconfrontational as i can considering at the beginning dismissal wasnt even mentioned. He has been weird the way hasnt let the sites know i was coming and hasnt told me if he has got anything for friday or next week i seem to be doing all the prompting on what he should be doing next

Hi this the email i sent him/

I would like to thank you for the support you have given me over the last few weeks, however since receiving your letter of 11.9.15 where you mention dismissal I am confused and concerned and very worried considering i am moving house in the next month. I thought that you did not want to dismiss me. Can you please explain so I know if I should be looking for another job more in earnest although i noticed a retail security job in chord with ddg or is this my old job as i said i have had 1 interview but not heard back. Could you tell me if you have plans for today and next week for me yet.
what would happen if i was to appeal the decision to remove me from Chord as I see this as an option. Have a nice weekend.

Just a thought, if he does get back toy you saying you should be looking, you might want to raise the subject of a reference , you could just ask him if you could rely on him for a good reference. As I said before, I suspect it is their ultimate goal for you to leave however I still think you should go and see CAB . If they come up with some 'no win no fee' type of solicitor , think carefully and check them out. My local CAB did this to me on a different matter and it turns out they were not solicitors at all.

In this case it doesn't look like there's a reason for them not to give a good reference to start with, going by how that email reads, they'd be happy to recommend halsaps to work somewhere else.

Sadly the quality of advice you get from CAB can vary wildly depending on where you go and who you speak to. When it comes to employment matters, most CAB responses were woefully inadequate. One lady started googling stuff which is something I could have done myself. Another adviser printed off a list of local high street solicitors that dealt in employment matters; as you can imagine, they represent mostly respondents so they were quick to take the other side! :eek2: The only CAB I found that gave very solid employment advice was one in the City of London, and that was many years ago.

I do, with proper legal representation. See below for suggestions:  :thumb:

Three hours is not ages, once you get into the ET process, even three weeks is nothing! :mmph:

There may be many reasons he has not answered, he may be busy, on a day off, driving, in a meeting. Not everyone is glued to their email like me. Maybe he has had to ask someone else and is waiting on their reply.

I am as impatient as you, I want it not just now but yesterday , my P.A. is just hopeless ! I would sack her but a) i don't pay her and b she might take me to an E.T. lol

Try to relax and enjoy some time with your wife . Remember though to spend some time job hunting just in case and don't take the piss, they are paying you so technically in work hours you should be available

Is that legal insurance that often comes with home insurance? Good idea.

Are you based in Northern Ireland? The reason I ask is because you refer to Industrial Tribunal, and in England and Wales they've not been called that for a long time.
