    Hi all, I'm posting for advice on behalf of a friend. My friend was arrested last year at her workplace. She was arrested for a serious allegation, never charged and was released on bail pending further investigations. Eventually, the police dropped the case with no further action being taken. However, they stated that she would've been charged with a different offence but the time limit to do so had elapsed.
    The arrest was not anything to do with her employment directly. However, her employers are claiming that it affects her ability to do her job due to the nature of her clients.
    Is this gross misconduct?

    It depends on what she does and what the nature of the allegations were.

    The fact that the police preferred no charges is not necessarily determinative. The police, or rather the CPS, have to be satisfied that they have evidence "beyond reasonable doubt" that your friend did whatever it was she was alleged to have done. Her employer does not need to meet that standard of proof in order to dismiss.

      Thanks for the reply. My friend is certain that she will be dismissed and is worried about how to apply for other jobs. The arrest was of a "sensitive" nature...
