  • My job has been advertised without my knowledge. Any advice?

    Hi

    I am a general manager for a small construction company. My job has been advertised through a recruitment agency on Friday 9th Jan. I have not been made aware that they were looking to replace me at all.

    I started working for them in June 2014 and my probation was extended until end of Jan 2015 as there were a few issues with my performance which needed to be addressed. At my last meeting with line manager it was agreed that I was making good progress so felt there was nothing much to worry about.

    Seeing my job advertised though has been a shock to say the least!

    I am unsure now how to deal with this. I am thinking of going in to HR and to the chief exec in person - unannounced with the copy of the job advert and demanding to know what is going on but at the same time would not want to risk losing any upper hand that I may have legally by letting on that I know.

    Is it legal to advertise someones job without informing them first?

    Any advice on this would be much appreciated. I am wanting to move quickly on this.

    Are you the only General Manager in the company?

    When does your probationary period end?

      As you have only been there 6 months, softly softly... Was there any contractual guarantee of full time at the end of your probationary period?

        I think you need to talk to your line manger and have a gentle conversation to see if there are any issues about your performance. See if these need resolving . Ask about the advertising of your job and see what answers you get. But I think it is time to start looking elsewhere.

          Unfortunately first two years of employment you haven't got a lot of rights and the backstop is you can be made redundant, and well statutory redundancy starts after 2 years and is emmmm.. well anyway. Cover your bases and see what opportunities are out there but a chat with line manager won't do harm.:tinysmile_twink_t2:

            Obviously as you are aware you are still under probation. They are not obliged to keep you on if they have some issues with your performance.

            The fact they have started looking for someone else and have started advertising your job is clearly not a good sign. Added to that you have simply not been there long enough for any statutory protection to kick in.

            Time to cover your bases and look for another job.
