    Hi, I've resigned because I couldn't work with my employer's son. My employer is making life difficult for me now and are unable to get a job, because she is stating that she won't give me a reference because of my theft record( which I don't have and my attitude displayed) what is my options?

    I believe that an employer doesn't have to give reference unless it's in your contract details. However the following would apply should they give a negative reference...If the worker thinks they’ve been given an unfair or misleading reference, they may be able to claim damages in a court. The previous employer must be able to back up the reference - eg, by supplying examples of warning letters.

      My ex employer got hold of my piece of paper with the email adresses where I was going to apply. She send an email with a bad reference before I even applied... and the reference she gave is untrue. Even my certificate of service I cant use, because she put the wrong commencement date and that doesn't correspond with my commencement date on my CV.

          How did your employer get hold of the email address and also know that it was in connection with a new job? Contact the person who you say received a bad reference via email and say that you would like a copy of the email on the basis that it may contain misleading information and could be subject to future civil action being taken. They may refuse, but I doubt a company would want to make a decision on employing someone should the reference be found to contain untrue information.

            I was using the fax facility at my work, and was busy faxing my CV, thats how she found it. And my ex employer gave me a copy of the email she sent with the reference. Do I go to court, or do I see a lawyer first?
