  • Manager bullying help!

    Hi,

    Recently a manager has abused his position through repeated threats of getting me sacked, this was said behind closed doors. My union told me to put in a grievance which I did however the hearing was carried out by his friend. The mangers closed ranks as expected but then lied on a grand scale in order to undermine me and drag my name through the mud. The grievance notes were heavily doctored. I have a stage two hearing due but see little point as it will be more of the same. Just wondering where I stand legally and how I can protect myself?

    I`ve spoken to ACAS and they said all I can do is resign and go for constructive dismissal, which is a bit extreme in my view. Do employees actually have any rights?

    Don`t ask about my union, they think they are all powerful but they are useless.

    If you have not been working there for more than two years you have surprisingly few rights. You can't go for constructive dismissal or unfair dismissal. You are only protected if you are victimised or sacked because of disability, race, gender, sexuality or if you've been victimised as a result of highlighting a health and safety concern.

        Then you have protection against unfair dismissal. If they dismiss you they have to do so fairly. They must go through a fair and proper procedure and they must come to what an employment tribunal would regard as a reasonable conclusion.         If they lie or break the rules which from the sounds of it they probably will then you'll have a case for unfair dismissal at an ET if the worst comes to the worst. Covert recordings are allowed at employment tribunals if it's the only evidence you have to show that an employer has not fairly dismissed you.

          Thanks Harmonica, I did ask my union about recording it and they said I wouldn't be allowed but given what you've just said I will record it anyway.

            Unions hate covert recording because they usually have an agreement with the employer not to do this sort of thing. Just don't get caught because they could possibly sack you for breach of trust. It is however, perfectly lawful and you might be glad you did if it means at a later stage that you can prove that they lied or held a sham grievance/disciplinary hearing.
