You misunderstand Wales - or I have not made myself clear. No-one is "slagging off the Police" , who as you rightly say are obliged to investigate even if their time is being wasted.

It's the employers - or managers - or whoever is escalating this situation where no real crime has been committed yet two young people are being vilified.

Don't read like that to me but then im an idiot for not supporting alleged thieves my point is it needs to be sorted for the sake of the SD so she can get on with her life

Why is this getting to slagging off the Police now,a crime may have been committed so quite rightly they should investigate if it was a taped interview the person interviewed had a right to a copy of the tape and the right to remain silent, until this is resolved the SD must be worrying herself get it over with should be the advice

My Grandfather was a police officer, my Wife ran the local Police social club bar for many years, my Wife's Grandfather was a Police Inspector (my Sd's Grt Grandfather)-for more info look up the arrest and hanging of Alek Claydon, Northampton Goal. Three of my best friends are retired or serving Officers
The Police, police by "public consent" and are bound by rules, the same as we are, if we or the Police do not abide by those rules there could be ramifications. This is not SLAGGING off the Police, it is merely asking if they have handle the situation correctly. The same question could be asked of me and you in the course of everyday life or our employment and that also would not be slagging off. Point made?

It sounds to me that the Codes of Practice under the Police and Criminal Evidence Act 1984 (PACE) were not complied with, this being evidenced by the failure to provide or offer access to the Duty Solicitor. Were the colleagues informed of their rights under PACE? This is a legal requirement. The tape-recording of the interview is also a legal requirement under PACE. My opinion is that the colleagues need to seek professional legal advice from a legal professional specialising in Criminal Law, particularly, Criminal Defence.

Just got them..
She was offered a solicitor but refused-silly girl!!
Was read her rights but was told she was free to leave at any time after she had answered some questions-That does not sound right to me!

She is, if they ask to see her, going to use a duty one. I have advised her to go and see one before but she is "waiting and seeing". Not the best approach but....

Update
We have, rightly or wrongly told the company that we will not be attending any "appeal hearing" as this, in our opinion, is not what it is about. We have reinforced to them that it is a formal complaint about the breach of her personal data and the consequences of that breach. We have informed them that we will no longer be dealing with the HR department but taking advice from the Information Commissioners Office. They have been as much as useless and so we have put everything on hold to wait and see.
Nothing more has been heard by either staff members from the Police so did the company use this as a "back off" tactic, we may never know!
My SD & I feel that should no more be heard from either the company or the Police we let sleeping dogs lie now.

Should that be the case I would like to thank all those who contributed to this thread, for their advice and comments, both good or bad. Despite no decent result it has been a learning experience for me and a lesson learn't for my SD-Thank you.
