    Hi All

    had an accident at work 2010 and injured my back ...return to work after 13 weeks.... no back to work interview or accident investigation.... spoke with the boss to advise him no lifting for the next 6-9 months....
    Due to staff shortages during last year and part of this year got put in situations that I was expected to lift....no one was interested..... Went off in march 2012... with back problems

    SSP ran out on the 17th of September 2012 and yet my employers only gave me the form today..... yet under the employers guide of the HM revenue it clearly states within 7 days or if the company is aware at week 23 of the sickness going to the 28 weeks then it should be sent to ensure the smooth transiton to ESA

    Final welfare meeting today...outcome.... termination of employment contract.... no mention of this is the result of a capabilty investigation ...Ps purpose of the meeting my health and well being....to discuss how they could help me back to work which wasnt even discussed......any Dr could argue that my situation is a disablement..... I wasnt allowed a witness

    Once they was aware that I am still under going treatment that could go into next year they didnt wanna know it was just a case of we are terminating your employment..... big question is have I been unfairly dismissed ?

    who decided to terminate your contract

    what is the size of your company

    do you have a HR dept

    any absence stage warnings given so far

    any occupational health referal

    were you given any advance notice of this meeting by letter

      Hr Manager decided to terminate my contract......on the basis of my gp letter.... Size of company ...BIG.... Yes we do have a HR department....No Referal to occupational health and letter / meeting was a Final welfare meeting to discuss my well being and health... what may they do to help me back to work

        i am the legal and medical secretary for a national trade union and what you have said so far is not only unfair, but also unlawful dismissal

              all I can say is that they had a gp report letter about my back issue and during the meeting I made is clear that due to the pain I am suffering that I was struggling with basic day to day every day tasks.....

                Jesus! That's about the most unlawful dismissal I have ever read. Why didn't they just kick you as you walked out to make the message even clearer.

                Really sorry to hear about this dreadful treatment, I hope your back improves. Do send Miliitant a PM. Butts need kicking. :beagle:

                    Thanks for the advice so far... I have spoken to a solicitor about making a claim against the company about my work injury...but I may need to bring there employment team in on this....

                    Is there a time frame this has to be done by

                      it is three months less one day to bring a claim to the employment tribunal service from date of dismissal

                      were you given the option to appeal when you got the dismissal notice

                      did you receive any extra pay or remuneration as a result of your dismissal

                        From what the HR manager told me today that she will email me Monday with deatils of notice and moneys owning ...agreed time frame to move out the accomodation... owed annual leave

                            please update with what letter you receive on monday
                            the appeal against dismissal is only 5 days as the norm so i hope she is not playing for time

                            as of this moment are you dismissed as you mention sending you details about notice period

                            to be honest

                            this is the most blatant unlawful dismissal i have ever seen in all my years as being a rep

                            they are not even being subtle about it

                            if you need help with the emplyment claim let me know

                            i have done enough of them in my past

                              At the moment Im still under a GP's sick note that runs out on the 7th November....No I wasnt informed to a right of appeal
