had an accident at work 2010 and injured my back ...return to work after 13 weeks.... no back to work interview or accident investigation.... spoke with the boss to advise him no lifting for the next 6-9 months....
Due to staff shortages during last year and part of this year got put in situations that I was expected to lift....no one was interested..... Went off in march 2012... with back problems
SSP ran out on the 17th of September 2012 and yet my employers only gave me the form today..... yet under the employers guide of the HM revenue it clearly states within 7 days or if the company is aware at week 23 of the sickness going to the 28 weeks then it should be sent to ensure the smooth transiton to ESA
Final welfare meeting today...outcome.... termination of employment contract.... no mention of this is the result of a capabilty investigation ...Ps purpose of the meeting my health and well being....to discuss how they could help me back to work which wasnt even discussed......any Dr could argue that my situation is a disablement..... I wasnt allowed a witness
Once they was aware that I am still under going treatment that could go into next year they didnt wanna know it was just a case of we are terminating your employment..... big question is have I been unfairly dismissed ?
