    I agree 100% with the letter Celestine has drawn together and advise you to send it recorded delivery. ALWAYS keep a copy as well as the receipt for Recorded delivery mail.

    I want to ask the one question that has been bugging me which regards the 2nd Paypal account. Why was it set up? Do you know at all? That appears to be the fundamental issue, ie that payments went through paypal to the company card rather than an "over the counter payment".
    Can that be explained?

          Sorry - not been on for a couple of days. I am as well as can be expected. In regards to the above question regarding paypal- I use paypal for many internet purchases. However, I have looked on my paypal account and can not see my company card registered on there at all but it did come to light by paypal that I had 2 paypal accounts and I wasn't supposed to so they told me I had to close one. So I am unable to see whether I inadvertantly registered my company card instead of my personal one. I have also today had the following email from my old employers hr . ' Only a small number of people were privy to this information and I have asked all those concerned and nobody has contacted your new employer,

            Do you actually recall setting up the 2nd paypal account? Also does your manager know your company card details including the security code on the back of the card. In other words does she know the card number, issue number (if applicable) valid from and expiry date and security code on the back? I assume she does since the company will have access to the card account to see purchases etc.

              Teaboy, I think the bit in bold is very significant because the claim that this did not happen is a lie and is in writing. Worth a separate complaint to them since someone purporting to be from HR has lost the OP their job using details of the case.

                The thing i find worrying is that they still after taking you to a disciplinary, and informing your new job about the disciplinary have not produced any proof the purchases on the card were
                a) purchased by you
                b) not purchased in the line of work.

                And if they are so adamant that you have done this surely the police would be involved?

                  I don't know about you, Teaboy, but I am beginning to smell a rat called LFC's former manager. If LFC's former employer's HR have emailed LFC and confirmed no-one from HR contacted new employers, the history of bullying and harassment are reasonable grounds to suspect the former manager had a hand in this. I agree with Celestine that LFC needs to contact ACAS as a matter of priority. From what is in your post, it looks like you've hit on something and if the manager did have access to the account details, this could have repercussions not only for the former manager, but LFC's former employers, too.

                    Have you contacted ACAS yet? Please do so as soon as possible and start proceedings against your former employer.

                    It might now be worth contacting your 'new' employer and updating them that the phone call they received is allegedly 'not' from your former employers. This significantly affects things because that phone call is now NOT a reference and is actually Harassment.

                      See my post addressed to Teaboy. From what you say, it sounds like I'm not the only only one who is beginning to smell a rat at LFC's former employers. Given the history of bullying and harassment, my gut feeling is saying "former manager." What's your view?

                          Just picked up your post, Celestine. I agree 100%. I think LFC may have to consider involving the ICO (Improper Disclosure) and, possibly, police may have to become involved as this is Harassment per se under Section 2, Protection from Harassment Act 1997. They may suggest that LFC seeks an injunction under Section 3 of the Act. This is useful as defying an injunction carries an unlimited fine, or up to 5 years imprisonment, or both. LFC would have to apply to the court for an arrest warrant if they go down this route and the harassment continues. I'll look through other legislation and see if there are any other provisions that may be relevant. May take me a while, though. I'll get back asap.

                            I totally agree with you there leclerc. As it was an email, then it can be simply printed out and passed to the new employer or emailed to the new employer with an explanation from LFC

                            Thats exactly what my line of thinking is, as i asked about the card details and whether LFC recalls setting up the second paypal account or not, as it is possible the manager may be behind the whole thing is she had access to the card details. The key lies with the email address used and if the purchase was for a physical item and where the delivery address was. Because whoever owns the email address of has connections with the delievery address, is likely the guilty party.

                            I agree, LFC you need to forward the email from your old HR to your new employer as its they had not contacted your new employer at all and as such the new employer had no grounds in which to dismiss you and would now likely reinstate you. As it is clear you are likely the victim of a hate campaign from a former colleague or a 3rd party.
