        In retrospect do you think that this is perhaps the best advice you have recieved on here.

        There is no law anywhere that will make them give you a good reference if they do not want to i am affraid.

        I would try and put this all behind you and start afresh.

          not in cat in hell's chance of that happening now!! They have lost me the job I went through 2 gruelling interviews to get- went ahead with a disciplinary I knew nothing about, have still to date, yet to provide me with details of the transaction or transactions I have supposed to have made and now claiming they have not contacted my new employer at all- all this after I went off sick because of the harassment/bullying by my boss. what i have got left to loose now? nothing!! so no chance i'm gonna leave it at that and move on. exactly how i am supposed to move on if they potentially phone every new prospective employer up - like I'm ever going to be employable again!

            Finally received a response from my new employer confirming that is was infact the girl from my old employers HR that rang them . She was the one that told me no one had been in touch with my new employer. Had no response to my appeal letter. Does anyone have any suggestions as what to do next?

              Could your ex manager have used her name?

              This needs to go to Tribunal.

              Do you have home insurance, check if you have any legal cover.

                I would give ACAS a ring Home - Acas

                Also if you have a Law Centre in your area you could get free legal advice and they would be able to tell you if a tribunal is the best way to go

                  You have been invited to an appeal hearing where you can give your reasons for appeal and these will be considered,(attached copy invite). You will not receive a response on any relevant points to your appeal until the hearing. I did not call your new employers and therefore would ask you to seek clarification of if they had any confirmation in writing that I made this call and gave them that information and whether they clarified this by calling the HR dept back, as I would suggest they did not and therefore it would mean the call could in fact have been made by anyone

                      No, that is factually incorrect.

                      The call could NOT have come from 'anyone'.

                      The information contained within that call was only known to a very small group of people within your former employers company. It was also a subject of extreme confidentiality.

                      It would not be normal practise for a company to ring back a HR team to verify the identity of a referee.

                        Is that what the company has written? In that case, how could anyone give the specific name of the person who works in the HR Company if it was not anyone who was connected with that firm. Whether they could be anyone or not they have lost you your job and therefore the firm is liable for the fact that this happened.

                        Why are they doing disciplinary letters by email? If they are denying responsibility for the phone then why should you believe that this email is from their HR department?

                            It would appear that 2 firms, & in particular their HR dept.'s, are, to use a colourful colloquialism, 'bricking it'!

I just need to know if there really is any point going to the appeal- If I am reinstated, how do I trust my employers again after all this, yet I am a mum of three kids that cannot afford to be without any income . I have contacted a few legal people this morning and awaiting their responses

                                There is always the other view that, in going back, you could be pretty 'bulletproof,', they will owe you one, & there may well be a vacancy for a managerial position.
