    Is this legal?

    Hi,
    I am taking my employers to a Tribunal and they have already started the dirty tricks campaign (I expected this). Failing to respond in time, letter went missing etc. etc.
    Now they have contacted the ET through their 'representative' who claim to be a law firm, asking for extra time. The poorly photocopied letterhead gives an address, phone number and fax. No such firm is listed at the address or anywhere else, and believe me, I have tried everywhere, companies house, the Law Society etc. (no, I haven't rang the number as it is not really cricket to contact the other party directly!) Costs were also threatened and the whole thing looks as though it has been designed to scare me off by pretending to be represented by an employment law specialist. Can they get away with this? Is it an offence to send misleading documents? any advice would be gratefully received.

    Well if the so called 'Law Firm' do not exist then I am sure the people dealing with your claim will find this out soon enough.

            Well, it's almost two weeks since I heard from the ET. ACAS told me nearly a fortnight ago that they would contact the Respondent and I would probably get a phone call early last week to let me know what they are planning to do. I didn't ,so I'm guessing that they are stalling for time. I have contacted Community Legal Advice about the alleged law consultancy to see if they can throw up any information as to whether or not any action can be taken if they are using a fake firm to intimidate a claimant. Will post any news a.s.a.p.

              Hi,
              Just a quick update. Phoned ACAS today and, surprise surprise, they have not been able to get in touch with Respondent's representative. Does anyone know what happens if the rep refuses to play ball? I assume there must be some reasonable time limit, so will contact ET next week to see what happens next.

                What happens if the respondent doesn't reply

                The respondent in your case must send in a response within 28 days of the date that the claim is sent to them. They could get an extension if given by the Employment Tribunal. If they don’t reply within this time, or if they don’t supply the information that has been asked for, their response won’t be accepted.
                Default judgements

                In these cases, the Employment Judge can issue what’s called a ‘default judgment’ and will normally do so. This means they will make a decision about your claim without you having to go to a hearing.
                However, if you haven't given enough information about the money you are claiming, you may have to attend a 'remedies hearing'. This will allow the Employment Judge to make the necessary calculations.
                Section 6 of the ET1 claim form asks about the amount of money you are claiming. Make sure you give as much information as you can.

                  Received ET4 for Noticeof Hearing yesterday. It is going to be conducted by an Employment Judge sitting alone. Will update wth any news.
