It is not unusual for there to be differences of opinion in both parties view of the claim. You will need to deal with any inaccuracies via documentary evidence and your witness statement.

In respect of the costs statement, then a party can make an application for costs or a preparation for time order against the other party in the circumstances linked to below:

      https://www.legislation.gov.uk/nisr/...agraph/73/made

The whole document may be relevant to assisting with your claim as it is the legislation covering The Industrial Tribunals and Fair Employment Tribunal (Constitution and Rules of Procedure) Regulations (Northern Ireland) 2020.

It's legal blackmail knowing people can't afford to take them on.If I lost how would they reclaim the cost ?

They would have to make a costs application to the tribunal and prove their case based on the criteria set out in the link I sent you. It would be down to the Tribunal to decide whether any costs should be awarded against you. Tribunals in England and Wales tend to go with the principle of each party is responsible for their own costs and it is not the norm, but it does happen that costs are awarded against a claimant.

I have no experience of what that is like in NI so I cannot give an opinion just the facts of when a costs claim can arise.

Hi redstar I appreciate that a costs threat is very concerning for you but I cannot add any further comment to what I have said in my post #34, given my only experience of costs orders is based on the Tribunal system operating in England and Wales not in NI.

Thank you for clarifying I was not sure what you were meaning the way you had set it out so always best to check.

Effectively the tribunal is trying to encourage you and the respondent to resolve the dispute without it going to a full hearing. Below I have linked you to a document that sets out what Judicial Assessment is and touches on Judicial Mediation.
