  • Dismissal after self defence

    I am wondering if I have any legs to stand on with a form er employer. I was dismissed last Monday from my role as a care manager with people with learning difficulties as they alleged I physically abused a person I supported. The fact of the matter is that after 30 minutes of being punched by this person around my back and shoulders (punching) i held the person's wrists for 10 seconds to prevent them punching my face. No one was injured soon afterwards I was called into a meeting with no notice and ambushed over the matter. I stipulated that any person has the right to use force that is legal, proportionate and necessary to keep themselves safe but this was rejected and I was dismissed. I was not given any notice saying I was entitled to have a person with me. I am less than two years with employer but feel my human rights have been abused.

    Any such employer should have policies in place for self defence or related situations. Do they have ne? Did they follow it?

    That said, they could have just called you in and dismissed you without any kind of reason being given.

      The problem is that having had less than 2 years service you do not have the right to bring an Employment Tribunal claim for unfair dismissal.
