I am wondering if I have any legs to stand on with a form er employer. I was dismissed last Monday from my role as a care manager with people with learning difficulties as they alleged I physically abused a person I supported. The fact of the matter is that after 30 minutes of being punched by this person around my back and shoulders (punching) i held the person's wrists for 10 seconds to prevent them punching my face. No one was injured soon afterwards I was called into a meeting with no notice and ambushed over the matter. I stipulated that any person has the right to use force that is legal, proportionate and necessary to keep themselves safe but this was rejected and I was dismissed. I was not given any notice saying I was entitled to have a person with me. I am less than two years with employer but feel my human rights have been abused.

The problem is that having had less than 2 years service you do not have the right to bring an Employment Tribunal claim for unfair dismissal.Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.
