    Hi all,

    I have a query concerning my notice period for my part time job.
    I work a part time job where my only shifts are on-call/sleep in shifts, which due to the outcome of the court case in 2021, means I am actually paid less than the minimum wage.
    In querying my notice period with my employer I have been told that it is 3 months. There is actually some uncertainty over what notice period is stipulated in my contract, as the copy of the contract that I have seems incomplete, and makes no reference to a notice period (though I am unsure at the moment if the copy held on file that I signed may be the full copy that makes reference to 3 months notice due to time in role).
    I guess my question is, outside of what is stated in my contract, can an employer enforce such a long notice period when I have been deemed ineligible for minimum wage and seem to be contracted outside of the normal protocols for pay, yet inside the normal protocols for a standard notice period?
    Any thoughts?

    I would suggest that you ask for a copy of the contract held on file that you signed and double check your notice period as that is what you will be contractually obliged to give.

    You may be able to speak to you employer and agree on a compromise for a shorter notice period.
