  • Working back late time

My boss has recently told us that if we are late for work, we will have to make this time up from our unpaid lunch hour.
The working hours are 8:30 - 17:00, so 7.5 hours working time and 1 hour unpaid lunch break. We don’t get paid yea breaks etc.
My boss sent us an email to say that if we are late, we will have to deduct time from our lunch to work this back. But he said we had to work in increments of 15 minutes.
So if we start late at 8:36, 15 minutes will be taken from our lunch hour. And if we arrive late at 8:50, then 30 minutes will be taken off the unpaid lunch break.

Is this legal? I get working back the exact time you were late (so 6 minutes or 10 minutes etc) but surely they can’t make us work more than we are actually being paid for?

I do have to agree that if your employer is asking you to work in unpaid time to make up for the time you are late which is effectively time you are being paid for then it should be like for like.

I would suggest that if there are a number of you unhappy about this then you raise it with your boss as a collective.
If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com

I do not provide advice by PM although I may on occasion ask you to send me documents this way but any related advice will be provided back on your thread.

I do my best to provide good practical advice, however I do so without liability.
If you have any doubts then do please seek professional legal advice.

My old boss used to do this 40 years ago!

1 minute late meant losing 15 minutes pay.

We used to clock in so could see the exact time so eventually if anybody was a minute or 2 late they wouldn't clock in until a 15 minute period had passed.

So the employer wasn't getting any unpaid work for his spiteful actions but he continued with it and the employees continued with the game!

A friend asked for time off, but was told that not only would he have to make up that time but he would owe the company 2 1/2 times that time. This is a PLC we are talking about. The 'art of management' lost on that particular manager.
