  • My redundant role just re-advertised - I'm going for unfair dismissal should I apply?

    My redundancy is underway (I am in an individual consultation) on the grounds that my role was eliminated. There were issues with my manager and a solicitor thinks that I have grounds to claim unfair dismissal.

    I noticed today, that my manager has advertised a role that looks very much like the one I was made redundant from . I am tempted to apply just to delay my redundancy but I wonder if I am better using the fact that he has advertised the role as ammunition for unfair dismissal.

    Any suggestions welcome.

      I don't think you should reapply, simply because the facts as they stand are that they are making you redundant, you are minded to state 'unfair dismissal', by reapplying you hope to delay your redundancy, how? Fuzzy logic.

      You need the facts to be clear, otherwise things could be 'misconceived'.

        I would suggest that you email the person conducting the consultation process with you, mentioning that you have seen this job being advertised, which appears to be similar to the role you are being made redundant from and in which case why has this not been consider as a suitable alternative position to offer you to avoid a redundancy situation.
