    Evening All,

    Newbie...with hopefully a simple question.

    Can an employer insert a clause into a contract that is in direct breach of either Employment or Working Time Regulation Act?

    Which takes the superior legal position, the contract or the law?

      In short, definitely not. Any such clause which attempted to overide or curtail your statutory or disregard the law would be automatically invalid. However this assumes botj the contract and your statutory rights are being correctly interpreted.

        Would help if you could state what the clauae is. Further help can be found on the ACAS website or from a Union Representative. If you are not in a Union I would recommend joining one especially if yout employrr is consciously trying to circumvent the law
