  • Sacked whilst recovering from cancer , employer no longer wishes to pay holiday pay

    Called into a routine meeting after being off with breast cancer since May 2018 radium & chemo now completed .
    employer demanded I resign or I would be sacked .
    I am still signed off by doctor and Oncologist with expected to return to work in December 2019.
    i refused to resign so I was sacked and escorted off the premises
    I am starting ACAS on Monday but how do I stand .

    How long have you been employed with that Employer?

    Were you sacked FOR being ill and off sick ? or for something else?

    Had you gone in for a meeting with your employer when he told you to resign or be sacked and they escorted you off the premises? What was that meeting for etc ?

    And where does holiday pay come into it?

      Thank you for your reply
      I have been employed for over 4 years continuously
      sacked for being sick only , no appraisal or supervision
      it was supposed to be just a routine meeting to update their records they said .
      They said they still had to pay my holiday pay whilst I was off by law so needed to sack me . They said a job would left open for me for when I was better . They sacked me when I refused to resign told me to get off the premises and never come back .

          Well my thoughts are that you would have a very strong claim here. Firstly you are covered under the Equality Act bearing in mind under this act you would be considered as disabled due to your condition. Secondly there was no process followed in regard to sacking you.

          When did this all take place? Have they followed it up in writing?

          I hope that your discussion with ACAS today was positive.

            I can’t thank you enough for replying this all happened in the last three weeks employer confirmed sacking in writing, so we have appealed and are in the process of going through ACAS before a tribunal.

              Thank you for your update. Exhausting the internal process by appealing is the correct process to take alongside your submission to ACAS for early conciliation prior to any tribunal.
