  • Training Agreement Query

    Hello,

I have a query regarding a training agreement i would be very grateful if someone could shed some light on.

As per my contract, there is a clause which stats the upon leaving the company i agree to deductions from salary and variable pay due to the company or company in the group. I was offered the opportunity to attend a training course which costs x amount but in order for me to attend i was required to sign a separate piece of paper ( training agreement). The agreement outlines the cost of the training and repayment scale if i were to leave the company within x years. i.e. if left after 4 months i would have to pay back £1000, if left after 8 months i would have to pay back £500 etc, if left after 1 year i would have to pay back £0

The agreement was signed by myself and another individual (HR) prior to the course starting, however the final party (manager) did not sign the agreement till after the training had been completed. If i were to leave the company before the 1 year, is it still legal for the company to make deductions from my final salary even though the agreement was not fully signed till after the training course had finished?

    Thanks

Yes. You agreed to it and signed the contract before doing the training course.

Even though the contract and training agreement are two separate documents? The training agreement was only fully signed after the course had finished.

You, and HR, signed it before you started the training, it was only the manager didn't get around to signing it until after. ie. you were aware and agreed to the terms before undertaking the training.

Presumably you now want to leave before the year is up and are trying to see if there's a way around having to repay some of the training costs?
