    Hi everyone, I work for a council run organisation where I have been subjected to bullying and harassment and also some sexual discrimination. I started the grievance procedure and because they have dragged their heels so much with it, going massively out of policy with timescales (still ongoing over 10 months later). Apparently I am out of the timescales to make a discrimination claim as the ‘act’ happened well over 6 months ago. Now if the grievance had been completed and finished within the policy timescales (28 working days) I would have had a chance to log this behaviour within the relevant timescales. Is there anything I can do about this now as I’m being told that it’s just too late.

    Unfortunately discrimination case claims must be lodged within three months (minus one day) of the act or acts of discrimination about which you are complaining. So, if there have been no further acts since you raised your grievance then yes you would be out of time. I know it is a bit late now but what you should have done when the grievance was dragging on, was to submit ET claim and as part of the information explain that you were mid grievance procedure but that due to delays you would have been out of time if you waited to exhaust the process.

    The only other thing is whether there has been any continuing discrimination or a series of acts of discrimination in which case you may be able to argue a series of linked acts
