  • *URGENT ACTION NEEDED TONIGHT* - received letter for termination of employment

    I have received a letter today from my employer stating 'please accept this letter that we will be terminating your contract with effect on 4/2/19'. However, after that they have put 'we will provide you with one weeks paid notice, and you will also be paid 2 days holiday which you are entitled to. Your final working day will be 8th February'.

    I have sought legal advice today from 2 solicitors and they have advised that due to the letter stating my employment contract has expired today, I don't have to return to work tomorrow.

    My question is, do I need to legally go into the workplace tomorrow as my contract has now expired? And are they obliged to pay me like they have stated until the 8th if I do not go in tomorrow?

    Also, if i do not need to go in, please can i have some advice on a structure of letter to post to them tonight.

    You have worked there less than 2 years presumably?

    I'm not suprised you aren't sure - that letter is worded terribly - is that exactly what they have put ?

      Yes I would have worked there a year tomorrow.

      That is exactly what they have put in the letter. Are you able to confirm whether I have to return to the workplace tomorrow as they are suggesting or if I choose not to return would I be jeopardising any salary due as per their statement i have mentioned above.

        Unless they have asked you to go on gardening leave, you need to go in tomorrow and work the 1 week notice.

          At this time of year it's real easy to catch a cold and no one feels like going to work with a cold. You can self certificate for the first 7 days which will take you to the end of the week.

            Sorry did not pick this up yesterday. It is a badly worded email but my interpretation is that your final working day will be Fri and then you will paid one weeks' notice for which it seems you will not need to work and then 2 days holiday pay which should equal the amount of untaken but accrued holiday up until your final working day.

            Just also double check your contract because if this allows for greater than one week's notice, then is it is the greater notice period that you should be paid.
