  • Use of CCTV in the workplace

    My husband's employer, sometime ago had CCTV cameras installed throughout the building.

    In a recent handbook on company rules and guidelines my husband wants to know something.

    It states in this so-called handbook the following:-

    "The company's premises are protected by 24-hour CCTV surveillance and video recording. The company reserves the right to use any CCTV footage in disciplinary or investigative procedures".

    The concern is about the fact that the boss is well known to sit in the office on a regular, sometimes daily basis, spying on staff and watching what they are doing, and is common knowledge he does this.

    Surely under Data Protection, this would be illegal monitoring?

      If he is watching are the not doing the job they are paid to do is that their worry? CCTV is everywhere watching us at work in shops in public places so we are all watched

              You can contact the ICO and they will be able to advise you. Also explain to them your concerns.

              If the business is small, did you also type in owners name?

                Its a small family run business.

                Typed in bosses name, again nothing come up!!

                  Ok as said before take guidance from the ICO. The fact that you state a hand book already mentions the use of CCTV it can’t be argued with the ICO that there is none at the workplace.

                    But surely if the company is not registered is the main issue of monitoring staff using CCTV surely that is downright illegal!?

                      That is why I said first is to check with the ICO to elimante all doubt, then when the facts are presented to you, you can report it under data protection rules.

                      they have already admitted to if need be using and recording employees via CCTV in their handbook.

                          No it means to ask the ICO about the legalities of using the CCTV and recording of its employees for discipline purposes, whether they are registered with the ICO for such purposes, the implications if they are not registered, and finally if your husband has such worries, he can always submitted a subject access request to the company. This can ask for any information that the company has on him (including CCTV footage).

                            I have sent an email to the ICO this morning asking is it legal for the boss to sit in the office and observe staff going about their daily routine through these cameras. Also there are no warning signs about the cameras, it just mentions about them in the company handbook. Waiting to hear back from the ICO.
