  • time off in lieu legal advice

    Hi

I have 720 hours banked as time off in lieu went to HR and asked for this to be paid, general manager said no as then he would have to pay everyone the only way to get paid these hours would be to leave the company. No one in the company has this amount of hours owed or has ever had this amount to date.

I guess all i want is to know the laws behind the time off in lieu "banked hours" system as i cant find any laws concerning this anywhere. Or just some advice on what to do as handing in my notice seems to be my only option here.

    thanks for reading.

Or you could take the time off.

Assuming you work 8 hour days that's 90 days worth of leave to take and faced with the request for the leave the company might take a view it is better to pay you for them as opposed to let you have time off.

always remember in the real life world of jobs, being too pushy could result in at a later time excuse to be relieved of that job thru any excuse they could get away with, do not rely on Tribunals either they have proven many a times to be a waste of time. learn from other countries be a pain in the Butt and eventually you end up out of work, this country so called rules etc are a flop in practice unless of course you have plenty of monies to challenge/settle out of court learn from us old ones who have been through it - Forewarned is Forearmed =

That is not to say bring to the employers attention, facts not any threats and you should be O.K. in achieving your goal!

They decide when i take the time off though I have no control over anything here. This is why i want legal advice as i cant comprehend how this is a fair exchange of services, you don't go to the bank get a loan and just say ill pay it back whenever i want, the person owed should have control over this.

I'm going to request a copy of my contract tomorrow as i lost it like 4 years ago. I highly doubt there will be anything on there that favors me here though. I'm pretty sure if i handed my notice in they would pay my hours anyway as i'm quite highly valued at this company, there options would be pay my hours and lose me or pay my hours and keep me. I would rather not force that issue without legal advice first though.

Details that are in your contract re lieu time would be good to know if you do get hold of them.

Is time off in lieu worked as part of a flexi-time system?
