    I was wondering if anyone could offer some advice. I am contracted for a 39 hour week and normally required to work 5 over 7 on weeks where I have worked for example 35 hours over 4 days I have used 4 hours holiday to make me up to my 39 hour contract. My employer is now accusing me of fraud as I am using 4 hours holiday but having a full day off.

    You're not having a full day off, you are having 4 hours off and if you didn't take holiday you would only work those 4 hours, then go home for the remainder of the day.

    I think you just need to make that point, then work the remaining 4 hours next time and go home after it to demonstrate the point. Hopefully that'll make them see how stupid they're being.

      Normally contracts stipulate number of hours you are required to work each day which add up to your weekly hours. Based on the information you have given that would make your daily hours 7.8 for 5 days.

      Do you have a system to record your hours so that you can prove you have worked 35 hours over 4 days?

      Are you allowed to be flexible and work more hours in a day because if you worked 35 hours in 4 days that would mean an average of 8.75 hour each day?

      Answers to these questions would help in being able to provide a response to your query.
