Received a letter if claim today, 03/03/2026 that is dated 23/02/2026, goving me 30 days to return the forms before court proceedings. I'm not sure why a letter should take a week, even second class. I'm very anxious and need some advice. I don't want a CCJ

You still don't say what it's for?Originally posted by Katiexhang View PostIt is a letter before action. It states that if I don't respond in 30 days pr pay in full, they will start proceedings. There rea two forms included, a reply form asking if I agree to the debt or want to dispute and a financial statement form.
Is it a Credit Card, loan etc?
Whether the alleged debt is owed?
Do you want to Defend the claim if they start proceedings?

Yes, we can't advise without knowing more about the debt.
How much are they asking you to pay?
Do you agree you owe it or do you want to challenge some or all of it?
If you agree you owe it and are willing to pay it then you can avoid a CCJ by paying either in one payment (if you have the money to do that) or negotiating a repayment plan.

What you could do is fill in an income and expenditure form.
Remember a Court will only ask you to pay what you can afford, so if that's £1 a month so be it.
When you fill in the I & E form, make sure you make allowances for the 'Cost of Living', it looks like
things will continue to go up i.e. energy, food etc. So give your self some 'leeway', don't over commit.
Write 'Without Prejudice' on the letter, amend the letter (so if it goes to Court, the letter can't be presented as evidence
against you). Make sure you get Proof of Postage.

No.Originally posted by Katiexhang View PostThey are requesting details of my employer at the bottom. Do I have to tell them that?
The income and expenditure form issued by the courts [Annex 2 Financial Statement here debt-pap.pdf ] does not ask the name of your employer, only your employment status. The request for the employer's name is presumably something Kearns have added themselves. Just ignore it.
