    Hello
I had an arrangement with marstons to pay council tax debt, I thought I paid but had not paid the last payment of £32 and today I had a hand delivered letter today for £267. I rang the man who told me call back after 11 so the system could update. I rang him back and he said a removal van would be at mine within half an hour( he said it might be longer as he was with the police at another job) so I had no choice to pay. My concerns are that I had no notice of enforcement letter telling me about any of this and had 2.30 hours to pay after finding out. Does this seem normal procedure
    thankyou

      Hi Sophsmith

      Welcome to LB

It sounds 'ridiculous', did they send any reminders regards the £32?
What you need to do is lodge a formal complaint via Marstons website, do it in writing.

Explain what happened, your personal circumstances, you didn't receive any notification regards the £32, had you received notification you would have paid immediately. Make sure in your complaint you give dates / time lines etc

I’ve complained already.. I had no communication with Marston regarding the £32 until he posted the letter. He don’t even knock on the door.

          Who did you complain to?

O.K. Update when you get a response from Marstons.

In the meantime, you could send them one of these - https://legalbeagles.info/library/gu...ccess-request/

Spoke to marstons and they explained when I was in compliance stage I got a notice of enforcement when they let me know about the debt so because I broke agreement they don’t need to send another and bailiff can turn up whenever *♀️

                    That is 'ridiculous'.

Surely, if they want to collect payment, which is what they want, they would want you to be there.
So they need to tell you before their arrival. Them arriving and you not being there doesn't make sense.

You could complain to the Financial Conduct Authority (FCA) and the Ministry of Justice.

I agree it sounds ridiculous. They sent a letter on 19/11 to let me know I broke the agreement. Problem is that letter still hasn’t arrived. Does it sound right what there saying about the notice of enforcement and not needing to send second one out?

Have they ever sent you a text or email?

It doesn't sound fair or reasonable.

I'd send a SAR request, it should show the actions they have taken.

I’ve had zero communication with them. I’m more curious if they needed to send another notice of enforcement after I broke agreement. I’m going to wait until after complaints team get back to me because no matter what happens it was my fault for not paying the last payment.
