  • Slow solicitor?

    Hello,

More than a year ago I have instructed (and paid for) a solicitor to deal with a debtor that does not want to give me back the money I lent him. During this year the solicitor had only sent 3 or 4 letters to the debtor, to which he never replied, filled in a court claim and more recently tried to hand in the claim to the debtor. However, in the meantime, the debtor divorced from his wife and left his home. He likely moved to the home of his new partner but we do not know it and do not know where he now actually lives. I have asked the solicitor to submit the claim electronically via email (I understand that it should be possible via the CCBC service) however the solicitor told me that they still have, in any case, to give the claim letter directly to the debtor before proceeding with the court claim and for this he is requesting and evaluating (since almost 1 month) the services of some investigators. I have a couple of questions:
    1. Is it true what the solicitor says about the CCBC and the need of an investigator?
    2. Is 1 year of time a reasonable amount of time for what the solicitor has done so far? I find It very slow but I am not an expert and I am not sure

    Many thanks,

    Egit123

    1. The debtor's address has to be given, so this needs to be ascertained.

    2. What you say does not give a satisfactory picture.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Litigants in Person should download and read the Judiciary's handbook for litigants in person: https://www.judiciary.uk/wp-content/..._in_Person.pdf
