    I have made settlement offers on my letters before action (I have 2 on my liquidated business) and have now been given 1 week to provide 6 months of banks statements, asset and liabilities statements and mortgage statements. Yesterday which was Friday at close of business one settlement offer was rejected but the other still not mentioned. The creditors solicitor mentioned equity in my home which I can see is a scare tactic to pressure me, particularly as it was emailed at close of business before the weekend when I can’t get in touch with anybody until Monday when my financial details have to be submitted.
    can I ask for longer to provide my financial position? One week is a short timeframe particularly when I have not been given a response on both of my settlement offers. Do I have to provide this information before my settlement offers have both been returned?

    Have a read of Pre-action protocols, 'Steps before issuing a claim at Court' No.6.

    Ask for an extension, I'd ask for 21 days although it says 14 days, see what they come back with, state that the extension asked for is asked for under the Pre-action protocols. That it will take time to get hold of the requested information.

    You could also state that if you have to make information requests to banks etc under a SAR request, then it could take up to 30 days.

      Hi echat11,

      Thank you for your advice, I will ask for longer and follow this advice. I presume they can take as long as they like to reply to my settlement offers? I have lots of deadlines imposed on me but I don’t have any idea of when I will receive responses on any of my replies.

        The bottom line is that they want information that you haven't got, then it will take time for you to get that information.

        'Play it by ear'. You can show the Court that you requested more time and they were 'unreasonable'.
