How to dispute a CCJ

Hi All

My Daughter has a CCJ from like 4 odd years ago

Apparently there was a parking ticket under a car she wasn’t registered to. She didnt even have her license at the time, never mind a car.

The ticket wasn’t paid for so it ended up becoming a CCJ

She only found out about it when they moved into their new home and the estate agents ran some tests - 3 months ago

Any advise on how to deal with this please?

Your daughter should complete form N244 and send it to the court along with the fee

If your daughter is successful with the reasons provided, the court will set aside the ccj

Unfortunately this may not be the end of the matter. The clamant may decide to continue to chase payment and your daughter may have to prepare a defence

Did the estate agent discover a charging order has recently been placed on the property she has purchased?

So if your daughter did not own a car and didn't drive a car (no driving licence) how did she come to be sued for the PCN? How did she ever get linked to the matter? She should phone the court that issued the CCJ and ask for a copy of the claim form and judgement. Post it here (with all personal deatils and reference numbers covered up) when you get it.

Did the CCJ come to light because the the estate agents were checking her eligibility for a mortgage and the CCJ came up on her credit record?

I really dont know how she ended up with this. I've asked for all the paper work etc she got. Yes, it was part of the eligibility checks from the estate agents.

As part of the eligibility checks she got the following:

We have received your referencing form back and it has come back as not acceptable due to an active CCJ on your credit file for £322.

Address: XXXXXXXXXXXXXX
Amount: £ 322
Date: 03/05/2022
Satisfied/Discharged: No

My Daughter only passed her driving last year and she still doesn't own a car.

She then emailed ccbcfees@justice.gov.uk asking for further info but never heard back

Then once she has everything, what next?
