    I owe monies from a civil judgement that has not been recovered via bailiffs as I do not have assets to cover the debt. The claimant is trying to now make a charge against my wifes mortgage which I am not a party to and have never paid? I also do not reside at the property on a full time basis? Any advice on this?

    Are you listed at the Land Registry (title deeds) as a joint owner with your wife?

    I've never heard of a charge against a mortgage. Do you mean a charge on the property?

    People will be better able to advise if we know exactly what the claimant is trying to do. Can you upload a copy of the correspeondence you have received but remove/cover up all personal details that could identify you or your wife.

      I suspect this claimant is applying for a charging order on property. That suggests that the OP is at the very least a joint owner.
