  • Help[ needed with writing letter Before County Court Claim

    Dear team,

    I am just about to issue my landlord C Housing Association a letter before county court. Could you please take a look at the attached letters to see if I have structured it correctly? Further to this, do I have to put the amount that I am claiming? or, will "I now seek punative damages from CH, the amount will be set by the Court, although I well be requesting in excess of £20,000." be suffice?

    Please note, I have also attached my complaints with CH;s Reponses (redacted).


    I appreciate any assistance you maybe able to offer.

    Dear Sir/ Madam

    Could someone please help...

    My landlords legal team have responded to my Letter Before Claim, Claey are asking for information of which I cannot answer. My landlord only went back 6 yeats with my SARs request, so I am unable to state each and every service i wish to claim for. This is why I said punative damages of which I believe I have been reasonable.

    I appreciate any assistance which is offered.

    I did grant the extentiextention

      Data retention refers to keeping or storing the Organization’s data for different purposes such as everyday business operation, demonstrating compliance with the supervisory authority, or complying with a particular law.

      Data retention starts when one of the following scenarios happen:
      1. The initial purpose for data collection and processing has expired. Usually, a product or services contract with an individual has expired, an insurance policy has expired, or the individual stopped using a product, or a service.
      so still your landlord then all data held.

      If problems complain to Information commissioners office on line.

        Due to the fact my landlord has admited liability within their stage one responce, refunding me 6 years of unlawful charges. Further to this, given the fact my landlord refuse to suply me with all information requested via a sars request. Would I be able to request a court, punitive damages?

          you go to ICO and make a complaint failure to adhere to Full DSAR request, that shows you are trying to get the said item.

            Acknowledge Claim - within 14 days from Service

            Defend Claim - within 28 days from Service (IF you acknowledged in time)

            If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
