I sent off the CPR 31.14.last week and they received it Wednesday. I have also received there copy of the DQ. They have ticked the yes box for small claims mediation service. Should I do the same when i complete my DQ, even though i am defending the claim.

They either forgot to mention or avoided it in the POC. The debt was originally sold to Experto Credite/Vardie and they went on to sell it eventually to Aktic Kapital. Aktiv Kapital went on to sell it to Pra Group.

What you need is to get disclosure of the unreacted deeds but I don't imagine they will cough without a fight

I mean it's fair to say that I (and my firm) know a lot about what went on since we have the Deeds (under lock and key ).

No one else can reliably tell you what did/didn't happen and why/what is significant because at the moment no one else has the unredacted deeds.

That's how I won my case (I was the Defendant as well as part of my own legal team).

Without reading back through your thread I think you said that the POC conveniently forgot to mention Varde. Is that correct?

I mean it's fair to say that I (and my firm) know a lot about what went on since we have the Deeds (under lock and key ).

No one else can reliably tell you what did/didn't happen and why/what is significant because at the moment no one else has the unredacted deeds.

Aktiv Kapital bought Varde's MBNA debt book and Experto Credite continue to manage it for them. AK were sanctioned by the OFT for unfair debt collection activities including issuing SDs as a bullying tactic: = if I remember correct, also Vardie was based in Ireland
