    Good luck.
    Try to stay calm read your witness statement and if I may suggest, if asked a question, just answer the question and do not elaborate. Letting my mouth run away with me and wanting to score points was my biggest challenge but I succeeded.

    I think I only deviated to say I did not know what a DN was 10 odd years ago and I have lived at my address for x years and always deal with my post.

      Thanks for the advice Warwick.

      Jo said a chap named John Pugh will meet me there to deal with things. It will be nice to have a conclusion to this either way moving into the new year.

              John Pugh is a barrister who has specialised in debt related litigation for nearly 30 years. You'll be in safe hands with him.

                  Well, thanks to Joanne Connolly and Diana M from the forum it looks like Restons won't be coming to Birmingham for Monday's hearing. I've received the following good news. They've backed down and that's the end of the matter.

                  "The Claimant has agreed to dismiss the claim so the trial on 8 January 2018 is vacated and will not proceed.

                    Just to recap, this Claim was stayed for six months then Restons lifted the stay and made a Summary Judgment application to strike out your Defence. That was unsuccessful.

                    Then the proceedings continued until they agreed to dismiss the claim (Consent Order) .

                    The Claimant has dismissed the claim themselves so no need for a Judge to decide the outcome at Trial on Monday.

                    Perhaps [MENTION=49370]Kati[/MENTION] would be kind enough to change your thread title to ** WON** because you have won (it’s been dismissed not discontinued )

                    Incidentally the Claimant was Cabot Financial (UK) Ltd - just thought I’d mention that. Jo and I are also pleased with the result!

                    You can now put this nightmare behind you which has been going on for nearly a whole year.

                          This is promising news. Out of interest does this mean that another DP couldn't try to proceed with court proceedings at a later date given that there was no judgement?

                            Received the following letters in the post this morning. Presumably posted out before the decision not to proceed. It includes copies of documents they've already sent me and we were challenging. An illegible credit agreement etc etc..... Just shows these parasites never back down unless you fight back.

                            Given the news from Joanna these letters are now in the bin where they belong and that's the end of it.

                              My understanding is they can't take it to court again and if they sell it on whoever buys it can't either.
