      I think I just need clarification on a couple of things...

      Do I submit the CPR to them by email today, now, and hold off with filing my defence (seeing as the ultimate deadline can go over to Monday)?

      and/or

      If either they do not come back to me (by latest, say, 2pm on Monday) or they do not agree to the extension, then I go ahead and file the defence that I have.?

        My time is running out, and in lieu of any feedback on my last question, I will have to take the plunge and send the CPR to Mortimer Clarke by email now, if they are even going to have the remotest chance to humour me with the courtesy of a reply and/or extension before end of play on Monday. I fear being frowned upon by the court as having unreasonably requested the information/extension and expected a favourable response, if at all considering they have 7 days, at the last minute

        Thank you all sincerely for your input thus far. Fingers crossed.

          No panic.

          If they haven't responded by the time you have to file your defence, just put 'CPR 31.14 request sent to MC sols (date); awaiting reply' as part of the defence. (In your own words).

              Good afternoon all, I trust you are having a pleasant Sunday afternoon :-)

              Just to update you on matters....

              At last call, I had submitted my Defence in time, made all the necessary information requests from both Mortimer Clarke and Sky and patiently awaited with trembling trepidation the outcome/setting down date for a hearing.

              Low and behold I received a letter from Mortimer Clarke, informing me of the following:

              We write in reference to the above and we have been instructed by our Client to discontinue proceedings and close our file. As such, please find enclosed a copy of the Notice of Discontinuance by way of service upon you.
              Well stone me! I was not expecting them to concede without putting up a little bit of a fight at least, even though I knew I could prove that the debt wasn't mine. They didn't return my £1.00 postal order either, lol - cheeky! I've got a good mind to request it. As for Sky, I never heard from them again in respect of my SAR and the investigation they said they would undertake.

              Nevertheless, it has all turned out favourably and I really am grateful to all ( [MENTION=5553]charitynjw[/MENTION] @Kati [MENTION=19893]Deb[/MENTION]t-Camel @R0b @nemesis45 @pt2537 and @diana-M (forgive me if I have missed anyone else/failed to mention you personally)) who gave guidance as to how to respond to the claim, without which I would have undoubtedly struggled.                     Your post sounds like an 'on stage' speech from someone who has just won a Hollywood Oscar

                    The Claimant has discontinued their claim against you. They'll never tell you why they discontinued (far too humiliating) so simply enjoy/accept the surrender.

                    You filed your Defence before they discontinued the claim so they can't re-issue a claim against you for the same or substantially the same facts in their POC and as importantly any legal issues which you raised in your Defence even if they weren't in the Claimant's POC, without making an application to the court for permission.

                    I'm so happy for you.
