Re: Lowell Portfolio Ltd vs S Lonie - Court date of 1st February - need to submit def

    Hi Di,

I didnt raise the SB in my defence because i cant state for definate, and I have no paperwork to support that it would be. I have no idea what this debt is, and im waiting for them to prove it, which they still havent done.

It looks like I have no choice now but to take the day off, and go to court, so this whole thing is already costing me, not only time, and stress but financially as well.

Will have to hope i get a nice DJ on the day, fingers crossed..

I amended the witness statement, copied the exhibits I was including and posted the documents 1st class signed for on the 16.1.17. Usually these papers, are delivered within one day. I have checked the tracking numbers on the postal receipts, the court have received their copy, and signed for it. Amazingly, and it comes as no surprise, neither Lowell, or their solicitors tracking numbers show that the papers have been received.

What would you recommend? I send them again tommorrow, but this time special delivery by 1pm? what do you think?

      kind regards

Lowlife solicitors don't seem to know what day it is, I would check again tomorrow.

You have proof of next day signed for post so keep it safe.

          Thanks Nem,

I am amazed that this is going to court, when they havent provided me with any form of paperwork, or the statutory information that I asked for. Its mind boggling. They use threats and scare tactics to make people roll over and send them money.

          I find them disgusting.

I agree Lowlife and it's solicitors push forward with claims without having the evidence to back them up for two reasons, 1.they hope to acquire the documents and 2. To put pressure on the defendant in the hope they give up and pay.

The great majority of the debt collection claims go undefended.

I have checked my tracking numbers again today, and the papers still havent been signed for at Lowell. or at their solicitors.

I havent received any paperwork from them either, Today is the 14th day before the court hearing on the 1st February.

Do I resend papers? Its not looking good at the moment.

You have the proof that you have responded as required so keep your posting certificate safe. Have they not sent their WS ?

Check with the court tomorrow see if they have filed.
