    Thank you, I'll pull it all together tomorrow, get my head around what I'm sending and then come back

    Just one thing, do I need to send copies of the things they sent to me? If so, do I still call them "Exhibit DW" or would they be submitted by the claimant?

    Part of me thinks that I should send them, even though they aren't technically exhibits for defence as they're what will be used for the claimant's case

    I'll copy them, just in case !

      I would label ALL supporting evidence (even documents/letters from the Claimant/sols) & include them in the 'bundles'.
      Ok to put Exhibit DW1, Exhibit DW2, etc

          Hi,
          That's fine, one amendment para 8. The defendant avers that the alleged debt is statute barred under the provisions of the Limitation Act 1980 as no payments or written acknowledgment of the alleged debt have been made in more that 6 years.

          8(a) The claimant is not able to enforce the alleged debt.

            I've made the amendments as suggested, and will post them tomorrow. The court date is 24th January, so the information has to be at the court no later than 14 days prior (Royal Mail recorded should get it there by Monday)

            I'll let you know how it goes!

              It's Sunday evening, and I'm just a little worried about Royal Mail getting my letter to the court in time.

              I checked a letter that I sent 31st December (recorded) and it hasn't yet been received, so now I'm worried that I might have the same problem.

              I'll keep checking the track and trace with Royal Mail, but is it worth sending again on Monday, with a guaranteed delivery?

              Or, is the fact that I sent it and can prove I sent it on Friday going to be good enough if the worst happens?

              As I'm typing, I'm talking this through in my mind, and think that if I check tomorrow (and it's not been delivered) then I'll go to the post office after work and send it next day guaranteed to court.

              As for Lowell, I can always send it again without a proof of delivery (proof of posting) just to be sure.

              Sorry, I'm using the thread as a sounding board this evening rather than looking for an answer - it's a good place to clear my thoughts.

                You could scan & email the WS & documents to the court as a backup.

                If it were me I would phone the court to get the correct email address.
                As for Lowells, I'd check track & trace again, but as long as you have proof of posting to the correct address, you're covered.

                  Thank you for that, I didn't think scanning / email was going to be an acceptable option (I don't know why, we use email for everything else)

                    I spoke to the court this morning, and the listing fee has been paid - so I'm going to court Tuesday 24th.

                    As suggested, I emailed them a copy of the WS and documents, and then checked tonight... everything has been delivered (but better safe than sorry). Even Lowell has their copy of my WS.

                    I'm just waiting now for their WS, and see what documents they are bringing.

                    Would it be OK to upload them for perusal, just to see if I need to be worried any more than I already am?

                        I've had a Notice of Discontinuance from Lowell (well from the court).

                        It's dated 11th January, so it's after the court and Lowell received my defence, and I can only presume that the WS was sufficient to make them review the claim and accept that it's Statute Barred.

                        I'll scan a copy on Monday and ask Kati to upload it.

                        Does this mean it's over?
