    So if I send this, headed Second Request for CCA:

    Please treat this letter as a formal request for you to supply a copy of my Consumer Credit Agreement as is my entitlement under sections 77-79 of the Consumer Credit Act 1974.

    I require you to provide me with a true copy, or reconstituted copy of the credit agreement relating to any account you deem to be mine, together with any other documentation the Act requires you to provide. I expect you to comply fully and properly with this request, within the statutory time limit.

    Your obligation also extends to providing me with a statement of account. I enclose a £1 postal order, which represents payment of the statutory fee payable under the Consumer Credit Act. I understand that a copy of my credit agreement should be supplied within 12 working days from the date of this letter.

    If this fee is not required for the request it must be returned to me forthwith, it must not be allocated to the alleged debt as a payment.

    If it is your view that you are not the creditor, s.175 of the CCA1974 applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. In the case of an absolute assignment, you are a creditor as defined by s.189.

    I understand that under the Consumer Credit Act, creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

          I have received a reply today from PRA:

          Request for copy of agreement

          I am in receipt of your second letter in relation to the above and have requested the required information.

          I have also enclosed your payment of £1.00 as this was not required to carry out the request.

          We will contact you to provide an update as soon as possible but if you have any further questions please telephone us on...

          Any advice on what I should do now?

            I have received a letter today from PRA:

            INFORMATION AS REQUESTED

            I refer to your request for copy documentation regarding the above account. We enclose documentation received to date and are awaiting further documentation to complete your request.

            If you have any questions regarding the enclosed information in the meantime, please contact...

            Enclosed was what I think is a computer print out of a list of entries (name, address, residential status, employment status, bank account etc), a bit like an application form. It says 'Internet' at the top of the list. It's just one page.

            I'm really not sure what to do now. Please help!

              Hi again everyone,

              I have today received a further letter from PRA Group:

              I have enclosed copy documents as requested.

              Please contact our office within 10 days of receipt of this letter on .... where an agent will be able to assist you.

              Our fully trained agents will discuss your account further with you and help you come to a mutually acceptable agreement in order to settle your outstanding balance.

              Yours sincerely...

              Enclosed are monthly statements from October 2011 to August 2012. The last payment I made was April 2012 which was £10 which was all I could afford.

              Please help! What do I do now?

                This is the 2nd time you've tried a CCA request for documents, isn't it?
                & they returned the £1 fee again?

                That document sent out on the 8th Aug, the 'application form'.......could you post it on this thread? (temporarily obscure any personal data).

                              That letter recently sent to you, & the enclosed 'stuff', does not even remotely come anywhere near to being a compliant response to a CCA request..........& you have now made 2 of them, plus Amethyst's CPR request (posted previously on this thread).
                              They cannot enforce this alleged debt until they do comply........if it were me I'd now do nothing, sit tight & await their next move (if any!)
