  • !! Won !! Notice of impending Legal Action: 5 year old Catologue Debt

    Hi All at legal beagles,

    5 years ago my life was very chaotic. Now I am disabled with Spinal Injury and other conditions and unable to work.

    I recently successfully defended a County Court Claim by CABOT for a 6k CREDITCARD Debt. They weren't able to provide CCA & CPR documents so I won.

    It has only been 3 months since my victory and now I have received a 'Notice of Impending Legal Action' by Lowell, represented by solicitors Cohen Cramer
    It is for a £2,201 CATALOGUE debt which went into Default in 29/11/2010.

    My question is should I defend this Catalogue debt in the same way as I defended my Credit Card debt?
    Are there any differences I should know about?

    They say its darkest before the dawn ..
    that last week getting confused with witness statement and prepping for court going as litigant in person fitted the bill. Thanks to Legal Beagals I got through it.

    THANKS !!

    I guess they wanted to test me all the way up to the line, as you said, test my metal. I reckon, going on how it was for me, that a lot of people will give up or self destruct, or settle .. which towards the end I was prepared to do !!

    Hello Amethyst and all,

    After working really hard and staying up all night on 2 occasions last week and at the weekend, I missed the Witness Statement deadline, but eventually managed to get a hardcopy of all documents to the court on Monday 24th October 2016.
    Also the same day I sent a special delivery hardcopy to Lowells Solicitors. This was in place of emails as I had a lot of problems with email file sizes etc. I made quite a few mistakes too, which I tried to correct as going along.
    I know I was given a lot of help, but I was still pushed past my limits. Some things I just did not know and could not find out, so I had to ad lib.
    It was a real ordeal.
    Anyway, the GOOD NEWS !! On the Tuesday the 25th October I received an email 'Notice of Discontinuance' from Lowells Solicitors Ltd.

    So that's it I'm very grateful to Legal Beagals (all those who helped me and Amethyst in particular). I'm also very lucky , I think, too. So thank you all very much!
    I'm really hoping no more court claims on me from now on!

    Hi all, HELP & ADVICE Needed please:tinysmile_cry_t: :rainsorry-time sensitive-again-sigh .. ):rain:

    I finally sent off witness statement and supporting documents to address I got from ringing up County Court at York and asking where to email my Witness Statement. The address I was given was enquires@york.countycourt.g.s.i.uk
    The address sent back 'UNDELIVERABLE email from postmaster'.

    So I went online and scrabbled about till I found another more likely looking email address: e-filing@york.countycourt.gsi.gov.uk
    (thanks a lot for giving me the wrong address County Court York)


    14:57 Saturday: Re-emailed Witness Statement (& supporting docs) to this address (16mb)
    19:13 Saturday: Emailed a bit of additional 'proof of postage' docs (2mb)

    So thinking that was the Court sorted I emailed a copy to Lowells Solicitors (below)

    19:36 Saturday: Emailed Witness Statement (& supporting docs) to Lowell Solicitors Ltd (14mb)

    *Not sure why the emails are different sizes, I will have to check what I sent, see if I sent anything twice, or missed something out.

    I started work today, to get hardcopy versions of my Witness Statement & supporting documents together to send off, only to see an out of hours reply from e-filing@york.countycourt.gsi.gov.uk
    to my emails (copied for your convenience at the bottom of my post).

    Among other things it says,'.. if you are filing a document by email to the Family and County Court sitting at York external customer facing email accounts, it is your responsibility to ensure it complies with the CPR Rules and the Court User Email Guidance.
    In particular the total size of the email must not exceed 2MB; statements of witnesses must not exceed 10 pages or the 2MB limit.

    So now I'm thinking the emails I have sent are too large ( ! )

    For some help and information I tried to click on a link (copied for your convenience from below) :

    ... but it says page not found !

    I also highlighted, ' Trial bundles must not be sent by email' (Is that what I have been trying to do?)

    Any emails that are received in these accounts that do not comply with the rules and guidance will be automatically rejected and the sender will not be notified that their email is unacceptable.
    Documents for hearings should be filed 2 clear working days prior to the hearing in order that the court can process them in time.

    thanks for responding .. My hearing is at County Court at York @ 2.00PM on 4th November 2016

    (I'm sorry I haven't posted since Wednesday, been under a really heavy work load in unfamiliar territory .. and struggling)
    Representative cant represent me because he is already too busy and is working somewhere else on the day.
    However, having just stayed up all night (again .. I'm knackered) I feel I'm better acquainted with my case now (having poured over it, working all night), and feel ok about going in as 'litigant in person' without representation now, if they accept my Witness statement and documents?
    (It should have been emailed before 4:00PM yesterday -- 14 days before my hearing)

    I've just sent off my Witness statement (1 day late, but better than nothing), hope its to the right email address? I sent my Witness Statement with supporting document exhibits to: e-filing@york.countycourt.gsi.gov.uk

    Just realised, Don't think my 'proof of delivery' receipts are visible in what I've sent, maybe I will send 'proof of delivery slips' again in an additional email.
    Its never ending.

    Why cant he represent you? (because he is not a barrister?)
