    Sorry I started a post yesterday asking for help. Then I found a post by amythest which told me which steps to follow and then it said create a new post with the title of the claimant V defendant.

    Sorry if I have confused anybody. I just want help to sort out this problem.

                The date of issue on the form was 28th April. Acknowledging the claim gives you 33 days from this date to get your defence in. Using the calculator link (http://www.timeanddate.com/date/dateadd.html) that gives you until the 31st May
                From Tuesday, 28 April 2015

                Added 33 days

                Result: Sunday, 31 May 2015

                  Ok Yes CPR31.14 to the solicitors, as said CCA no good for the mobile account.
                  You should send Lowell a prove it letter incorporating a request for the "agreement " mentioned in the claim..

                  Now give us a chronological account of this debt please.

                  Date the account was opened?
                  Date Defaulted?
                  Date last payment and/or written acknowledgment made.
                  Is this debt on your credit files?

                    Thanks for pointing out the incorrect dates Kati, I will edit the letter now as I haven't posted them yet. My acknowledgment has been sent though.

                    Nem is there a prove it template as I am not the best at writing letters and I wouldn't know what to write?

                    chronological account of debt.
                    Account opened August 2006
                    Last payment paid was January 2008
                    No written contact or telephone contact has been made since the last payment. I stupidly ignored the letters for years until the past 3 months I started receiving letters regarding the debt.

The debt is time barred under the limitation act 1980 section 5 in that the last payment or acknowledgement of this debt was made over 6 years ago and no further acknowledgement or payment has been made since that time
                      . If you have evidence that this debt isn’t statute barred then can you please provide evidence.
                      With reference to the above agreement I would be grateful if you would send me a copy of this credit agreement.

                      I understand that under the consumer credit act 1974 (sections 77-79), I am entitled to receive a legible copy of my credit agreement on request.
                      I enclose payment of £1.00 which represents the fee payable under the consumer credit act.

                      I understand a copy of my credit agreement should be supplied within 12 working days.

                        The Part re credit agreement is not relevant delete. Use a Copy of the service contract for this alleged account.
                        12 days +2 is for CCA delete.
                        No fee payable!!!
                        I will allow 7 working days from the date hereon for a response after which I will consider the matter closed.
