    Hi All,

    Hope you're good?

    I've found out that a CCJ has been issued against me last January, with no documentation reaching me due to a typo in the address Kearns Solicitors have used (the first line of the address states a different building to the one I resided in).

    As a result I've received a default judgement against myself.

    At this stage what would be the best action to take? Could I offer Kearns payment of the outstanding amount and then have the CCJ set aside despite being beyond the usual 28 day period?

    Or would an N244 stand up to the court despite being down the line?

    a) At this stage what would be the best action to take?

    The error was made by Kearns and you didn't receive the Court papers and decide how you wanted to proceed, defend or pay the claim,
    write to the Creditor, seek their consent to set a side the CCJ, explain that the error was made by Kearns, provide evidence.
    If they give consent then the fee for the N244 will be less. The Creditors consent with the N244 should be sent to the Court.

    Do not pay the Creditor before the Court approves the set a side. The Court might not approve the set a side, if you pay there is no reason
    for the Court to grant a set a side.
